Participation constitutes Entrant’s full and unconditional agreement to and acceptance of these Official Rules and the decisions of Sponsor, which are final and binding in all matters related to the Promotion.

II. PROMOTION PERIOD (TBD)

The Kontaineroz [NAME OF GIVEAWAY] (the “Promotion” or “Sweepstakes”) begins [START DATE] at [TIME] [TIME ZONE] and ends [END DATE] at [TIME] [TIME ZONE] (the “Promotion Period”). Sponsor’s website countdown timer is the official timekeeping device.

 

 

III. ELIGIBILITY

Not eligible: officers, directors, members, managers, employees, contractors, agents, and representatives of Sponsor, its parent/affiliate companies, advertising/promotion agencies, and any person involved in the development, administration, or fulfillment of this Promotion, and each of their immediate family members and household members.

This Promotion is subject to all applicable federal, state, and local laws and regulations and is void where prohibited.

 

 

IV. HOW TO ENTER

You are an “Entrant” once you submit a valid entry using one of the methods below during the Promotion Period. Limit one (1) entrant per person/email/household unless stated otherwise.

A) Purchase Entry 

During the Promotion Period, eligible customers will receive 1 entry per $1 spent on qualifying purchases on the Website (excluding taxes, shipping, refunds, chargebacks, and discounts).

  • Orders that are refunded, canceled, charged back, or returned (in whole or in part) may result in corresponding entries being voided.

B) Mail-In Entry 

To enter without purchase by mail, legibly hand-print on a 3”x5” or 4”x6” card:

  • Full name

  • Complete mailing address

  • City, State, ZIP

  • Email address

  • Phone number

  • Date of birth

Mail-in limits: one (1) envelope per person.

V. PROHIBITED CONDUCT

  • Automated entries (bots/scripts), bulk submissions, third-party entry services, falsified information, multiple identities, or any attempt to tamper with the Promotion are prohibited and may result in disqualification.

Sponsor may disqualify any Entrant suspected of fraud, abuse, or rule violations.

VII. WINNER SELECTION, ODDS, AND NOTIFICATION (TBD)

Selection: On or about [DRAW DATE], Sponsor/Administrator will randomly select through a third party sweepstakes platform the [NUMBER OF WINNERS] potential winner(s) from all eligible entries received.

Odds: Odds of winning depend on the total number of eligible entries received.

Notification: Potential winner(s) will be contacted by [email/phone]. If a potential winner cannot be reached, fails to respond within [48 hours / X days], is found ineligible, or fails to complete required documents, that potential winner may be disqualified and an alternate winner may be selected.

 

 

VIII. WINNER REQUIREMENTS / AFFIDAVIT / TAXES (TBD)

Winner may be required to sign and return (within [X days]) an Affidavit/Declaration of Eligibility, Liability Release, and (where lawful) a Publicity Release.

If prize value is $600+, Sponsor may require completion of a W-9 and may issue a Form 1099 as required by law. Winner is solely responsible for all federal, state, and local taxes and any other costs not expressly stated as included.

 

 

IX. PUBLICITY

Except where prohibited, acceptance of a prize constitutes permission for Sponsor to use winner’s name, city/state, likeness, photograph, and/or prize information for advertising and promotional purposes in any media worldwide without additional compensation.

 

 

X. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Entrant agrees to release and hold harmless Sponsor and its affiliates, and each of their owners, officers, directors, employees, and agents (the “Released Parties”) from any claim arising out of participation in the Promotion or receipt/use/misuse of any prize.

Released Parties are not responsible for:

  • technical failures of any kind (network, hardware, software, email delivery, etc.),

  • unauthorized human intervention,

  • errors in the administration of the Promotion,

  • late/lost/garbled entries or communications.

Sponsor may cancel, suspend, modify, or terminate the Promotion if it cannot be administered as planned due to events beyond Sponsor’s control (e.g., fraud, system failure, force majeure), and (if applicable) select winners from non-suspect eligible entries received prior to the disruption.

 

 

XI. PRIVACY

Information collected is subject to Sponsor’s Privacy Policy: https://kontaineroz.com/policies/privacy-policy Sponsor will use Entrant information to administer the Promotion, contact winners, and as otherwise described in the Privacy Policy.

 

 

XII. DISPUTES / GOVERNING LAW

These Official Rules are governed by the laws of California, without regard to conflict-of-laws rules.

Arbitration: Any dispute arising from the Promotion shall be resolved by binding arbitration administered by JAMS in Kern County California under its then-current rules, with one arbitrator, and the parties sharing arbitration costs equally unless applicable law requires otherwise.

XV. MISCELLANEOUS

If any provision is found unenforceable, the remainder remains in effect. Sponsor’s failure to enforce any term is not a waiver of that term.
